Filing a Divorce in Williamson County

Before filing, we evaluate the Texas residency requirements. At least one spouse generally must have lived in Texas for six months and in the filing county for 90 days. Because the proper filing location depends on the facts, we determine jurisdiction before preparing the initial documents.

For Williamson County cases, we account for filing requirements, standing orders, and court procedures. Standing orders govern the parties while a case is pending. A case may be assigned to the 395th, 425th, or 480th District Court. The Williamson County District Clerk maintains district court records, and applicable documents are filed electronically.

A divorce begins with a Petition. Depending on the circumstances, a party may also request a Temporary Restraining Order, a short-term court order addressing conduct or property while the case proceeds. The other spouse may file an Answer, and the parties can work toward an Agreed Decree of Divorce. When disputes remain, we use mediation before preparing for trial. If mediation doesn’t resolve every issue, the court may set a trial date.

Texas generally requires at least 60 days between filing and finalizing a divorce. An uncontested case may be finalized after that waiting period if all requirements are met. Contested cases usually take longer because discovery, mediation, unresolved terms, and court scheduling can affect the timeline.

Contested, Uncontested & Collaborative Paths

Texas permits no-fault divorce, meaning a court can grant a divorce based on one spouse’s belief that the marriage can’t be repaired. A spouse’s disagreement can’t by itself prevent the divorce, although disputes can affect how the case proceeds and which terms require court resolution.

Uncontested Divorce
An uncontested divorce requires agreement on every term that must appear in the final decree. Those terms may include property division, child custody and visitation, and child support. We prepare and review the required documents so the agreement is stated accurately before submission to the court.

Contested Divorce
A divorce is contested when the spouses disagree about one or more terms. We handle these cases through traditional litigation, which may involve temporary orders, information gathering, negotiations, mediation, and trial preparation. In mediation, a neutral third party facilitates negotiations without deciding the dispute.

Collaborative Law
The collaborative process allows spouses and their lawyers to work toward an agreement outside traditional litigation. We practice collaborative law, and Melissa M. Williams is a charter member of the Collaborative Institute of Texas.

Property, Parenting & Support Issues in Divorce

A final decree may need to resolve financial obligations, parenting arrangements, and ownership of marital assets. We identify the decisions required and explain how proposed terms could affect the client after the divorce.

Dividing Marital & Separate Property

Texas follows community property rules, but that doesn’t mean every asset is automatically divided equally. Courts divide the marital estate on a just and right basis after considering the circumstances. This process may require distinguishing marital assets from separate property, which generally includes qualifying assets owned before marriage or received by gift or inheritance.

We handle property division involving:

  • High-value assets
  • Business evaluations
  • Retirement accounts
  • Asset tracing to determine the source and character of property when separate and marital funds may have been combined

Child Custody, Visitation & Support

A divorce decree can address child custody, possession or visitation schedules, and child support. We help clients evaluate proposed parenting terms and support arrangements without promising a particular schedule or amount. Our representation focuses on the facts, applicable law, and child-related issues in the case.

Agreements & Order Modifications

We handle marital, cohabitation, and separation agreements that define financial or personal obligations between parties. We also represent clients seeking or responding to modifications of existing orders. Texas Family Code Chapter 156 governs many modification cases involving custody, support, and possession or visitation schedules.
